Terms of Service

The short version: SereniWings is a calming comfort tool for nervous flyers — not medical advice and not a medical device. Use it to relax, not to replace professional care. An account is optional; some features are paid. Purchases are made through Apple. The app licence itself is Apple's Standard End User License Agreement (EULA); these Terms of Service add the subscription, refund and service details. By using SereniWings you agree to both.

1. Who we are & acceptance

These Terms of Service (the "Terms") are an agreement between you and Allan Fowler, an independent sole trader (entrepreneur individuel / micro-entreprise) established in France ("we", "us"), the provider of the SereniWings app ("the app"). Your licence to use the app is governed by Apple's Standard End User License Agreement (EULA) (see section 9); these Terms of Service set out the additional service and subscription terms. By downloading, accessing or using the app you agree to these Terms, to Apple's Standard EULA, and to our Privacy Policy. 2. What SereniWings is

SereniWings is a wellbeing companion offering breathing exercises, grounding and relaxation techniques, reassurance and calming information to help people who feel anxious about flying. It works mainly offline; some optional features (such as weather along your route) use the internet when available.

Not medical advice. SereniWings is not a medical device and does not diagnose, treat, cure or prevent any condition. It is not a substitute for professional care. If anxiety is affecting your life, please speak with a qualified doctor or mental-health professional. In a crisis or emergency, contact your local emergency services.

3. Who can use it (eligibility)

The free experience needs no account and can be used locally by anyone. Creating an account requires you to be at least 16 years old — we use 16, the GDPR default age of digital consent, so one rule applies across every EU/EEA country. If you are under 16, please use the app without an account, or ask a parent or guardian to read and agree to these Terms on your behalf and set up any account for you. By creating an account you confirm you meet this requirement.

4. Your account

An account is optional and only unlocks features that also require a purchase. Accounts are provided through our processor Supabase (hosted in the EU, Paris region): your email and password are sent securely to Supabase, which stores your email and a securely-hashed password and manages your login. You are responsible for the accuracy of your details and for keeping your credentials secure. You can delete your account at any time from inside the app (Your account → Delete account); see the Privacy Policy for exactly what is deleted and what may be retained.

5. Purchases, subscriptions & the Flight Pass

SereniWings offers the following paid options, sold through Apple's in-app purchase. The exact, current price and period are always shown on the paywall and on the App Store product page before you buy, in your local currency.

How auto-renewable subscriptions work:

Apple is the seller of record. We never see or store your payment card details. Refunds are handled by Apple under the App Store terms and are requested from Apple (reportaproblem.apple.com); we cannot issue App Store refunds ourselves.

6. Your EU right of withdrawal (14 days)

As an EU/EEA consumer you normally have 14 days to withdraw from a purchase of digital content. Because the app's content is delivered to you immediately, by purchasing you expressly request immediate performance and acknowledge that you lose your right of withdrawal once delivery has begun, to the extent permitted by law. This does not affect your mandatory statutory consumer rights. Refunds for App Store purchases are, in any case, handled by Apple as described above.

7. Acceptable use & intellectual property

Please use the app only for its intended, lawful, personal and non-commercial purpose. You agree not to misuse, disrupt or gain unauthorised access to the app or its systems, and not to reverse-engineer or copy it except as permitted by law. The app, its content, design, text and artwork are owned by us or our licensors and are protected by law; we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the app for your own wellbeing. The content you create (your notes and journal) remains yours.

8. Disclaimers & limitation of liability

To the fullest extent permitted by law, the app is provided "as is" and "as available", without warranties of any kind, and we will not be liable for any indirect, incidental, special or consequential loss, or loss of data, arising from your use of (or inability to use) the app. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law (including liability for death or personal injury caused by negligence, or your mandatory statutory consumer rights).

9. App licence — Apple's Standard EULA

Your licence to use the SereniWings app is Apple's Standard End User License Agreement (the "Licensed Application End User License Agreement"), which you can read at apple.com/legal/internet-services/itunes/dev/stdeula. That agreement governs your use of the licensed application; these Terms of Service add the subscription, refund, consumer and service details above and do not replace it. 10. Changes to the app and these Terms

We may update the app and these Terms from time to time — for example to add features or reflect legal changes. When we make material changes we will update the "Last updated" date above and, where appropriate, tell you in the app. Continuing to use the app after changes take effect means you accept the updated Terms.

11. Governing law & disputes

These Terms are governed by the laws of France, without prejudice to any mandatory consumer-protection rights you enjoy in your country of residence. If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. For data-protection matters, the competent supervisory authority is the French CNIL (www.cnil.fr).
